Acts to be punished and measures of punishment
According to provisions of Law on Penalties for Administration of Public Security, any person who disturbs public order, endangers public safety, infringes on the personal rights or property rights of another person or hampers social administration, which is harmful to the society and which is not serious enough for criminal punishment, shall be punished by a penalty for administration of public security according to this Law by the public security organs of the People’s Republic of China.
Implementing organ for penalties for administration of public security
According to provisions of Law on Penalties for Administration of Public Security, the public security organs in China are the organs which decide and execute the penalties for administration of public security.
Measures of punishment can be taken for acts against the administration of public securityAccording to provisions of Law on Penalties for Administration of Public Security, for any person who violates the administration of public security, measures of punishment that the public security organs in China may take generally are: warnings, fine, administrative detention and revocation of licenses issued by the public security organs. To a foreigner who violates the administration of public security, in addition to the above penalties, leaving the country within a time limit or deportation attached to a penalty may also be applicable.
